Tonye Cole suit challenging Rivers State Governor Sim Fubara’s election victory was rejected by appeal court.

The Lagos State-based Court of Appeal today, November 28, dismissed a petition filed by Patrick Tonye-Cole, the governorship candidate of the All Progressives Congress (APC) in Rivers State against Governor Sim Fubara of the Peoples Democratic Party (PDP) and the Independent National Electoral Commission (INEC).

Tonye-Cole had appealed to the court to order INEC to declare Tonye-Cole the winner of the March 18 governorship election in Rivers State. In October, the Rivers State Governorship Election Court dismissed Tonye-Cole’s petition challenging Fubara’s election as governor of the state. The court ruled that the APC, which sponsored Cole in the election, had withdrawn its claim against fubara victory.

Unsatisfied with the Court’s ruling, the APC candidate appealed to the Court of Appeals. The Court of Appeal upheld the court’s verdict this morning, recognizing Gov. fubara as the duly elected governor of the state.
